Terms of Service
These Terms of Service ("Terms") govern your use of Stampa ("we", "us"), a loyalty and customer retention platform designed for businesses. By joining the waitlist, creating an account, or using the product in any way, you agree to these Terms.
Stampa is currently in early access. Features, pricing, and policies may evolve as we improve the product. We will update these Terms when material changes occur.
1. Eligibility and Accounts
Stampa is intended for use by businesses and organizations, not individual consumers acting for personal purposes.
- You must be at least 18 years old and authorized to act on behalf of the business or organization you represent.
- You are responsible for maintaining accurate account information and keeping your login credentials secure.
- You are responsible for all activity that occurs under your account.
2. Use of the Service
You agree to use Stampa in accordance with these Terms and the law.
- You will not use Stampa for any unlawful, fraudulent, or harmful activity.
- You will not abuse stamp or reward mechanics to mislead customers or partners.
- You will not attempt to interfere with or disrupt the platform, including by introducing malware or attempting unauthorized access.
- You are responsible for any content, offers, and collaborative rewards you create using Stampa and for complying with applicable advertising, consumer protection, and promotional laws.
3. Early Access and Beta Features
During early access, Stampa may include experimental or in-development features.
- Features, performance, and availability may change without notice.
- We may limit access, modify functionality, or discontinue parts of the service as we iterate.
- We welcome feedback to help us improve the product, and you agree that we may use feedback without obligation to you.
4. Subscriptions, Billing, and Payments
Paid plans for Stampa may be offered on a subscription basis. When you subscribe to a paid plan:
- Billing and payment processing are handled by our payment provider (currently Lemon Squeezy) on our behalf.
- By starting a subscription, you authorize our payment provider to charge the applicable fees using your selected payment method.
- Subscription terms, including trial periods, renewal dates, and cancellation windows, will be presented to you at checkout.
- Unless otherwise stated, subscriptions renew automatically until you cancel.
You are responsible for reviewing the pricing and plan details shown at the time of purchase. Any applicable taxes may be added to the subscription price.
5. Cancellations and Changes
- You may cancel your subscription according to the instructions provided in the billing portal or dashboard.
- Cancellation typically takes effect at the end of the current billing period, unless otherwise stated at checkout.
- We may modify our pricing and plan structure in the future, but will aim to provide reasonable notice of changes.
6. Data and Privacy
Our handling of personal information is described in our Privacy Policy.
- By using Stampa, you agree that we may process your information in accordance with the Privacy Policy.
- If you onboard your customers to Stampa (for example, through the wallet or loyalty programs), you are responsible for ensuring that your use of their data complies with applicable privacy laws.
7. Intellectual Property
- Stampa, including its design, code, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws.
- You retain ownership of the content and data you input into Stampa, including your business information, loyalty programs, and promotional assets.
- You grant us a limited license to use that content solely to operate and improve the service.
8. Suspension and Termination
- You may stop using Stampa at any time, and you may cancel subscriptions as described above.
- We may suspend or terminate access to the service if you materially breach these Terms, misuse the platform, or use it in ways that create risk for us or others.
- We may also discontinue or significantly change the service, in which case we will aim to provide reasonable notice when feasible.
9. Disclaimers
Stampa is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any particular business outcome, revenue increase, or customer behavior. Your results depend on many factors outside our control.
10. Limitation of Liability
To the fullest extent permitted by law, Stampa and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.
Our total liability for any claim arising out of or relating to these Terms or the service is limited to the amount you paid for the service during the 3 months prior to the event giving rise to the claim, or, if you are on a free or trial plan, USD $100.
11. Governing Law
These Terms will be governed by and construed in accordance with the laws applicable in your primary operating jurisdiction, unless otherwise specified in a separate written agreement. Any disputes will be handled in a competent court in a jurisdiction reasonably connected to Stampa's place of business.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of the page and, where appropriate, notify you through the product or by email. Continued use of Stampa after changes become effective constitutes acceptance of the updated Terms.
